User Agreement
1. Introduction
Welcome to the SINCAR inc. bidding and logistics portal. This User Agreement ("Agreement") governs your access to and use of our integrated platform, which allows users to browse Japanese car and machinery auctions, view sales statistics, place bids, and manage vehicle purchases and logistics. By registering an account and using the platform, you agree to be bound by these terms.
2. Account Registration and Access
To access live auction data, place bids, and view invoices, you must register for an account. You agree to provide accurate, current, and complete personal and corporate information during the registration process. You are strictly responsible for safeguarding your password and for all activities that occur under your account.
3. Deposits and Bidding Limits
To participate in live auctions, clients must maintain a sufficient security deposit in their SINCAR account. Your maximum bidding limit is directly tied to your cleared deposit balance. SINCAR inc. reserves the right to adjust bidding limits or suspend bidding privileges if deposit requirements are not met.
4. Bidding, Purchasing, and Cancellations
- Binding Bids & Cancellation Window: All bids placed through the system are legally binding. Clients may cancel or amend their bids directly through the portal up to 7 hours prior to the scheduled start time of the respective auction.
- No Cancellation Period: Once an auction is within 7 hours of its start time, bid cancellations are strictly prohibited. The client is fully committed to purchasing the vehicle if the bid is successful.
- Overbid Allowance: To maximize your chances of securing a vehicle in a fast-paced live auction environment, SINCAR inc. reserves the right to automatically overbid your submitted maximum bid by an amount of up to 10,000 JPY.
- Auction Conditions: Vehicles are sourced from third-party Japanese auction houses. SINCAR inc. provides translated auction sheets and inspection data as a convenience; however, all vehicles are ultimately sold "as-is."
5. Payments, Invoicing, and Currency
Upon a successful bid or fixed-price purchase, an invoice will be generated in your dashboard. You agree to remit payment in full according to the timeline specified. Failure to pay will result in account suspension, complete forfeiture of your security deposit, and cancellation of the purchase. All transactions are subject to exchange rate fluctuations, and clients are responsible for any bank transfer fees.
6. Logistics, Shipping, and Claims
- Shipping: SINCAR inc. arranges inland transportation and international shipping. We are not liable for delays caused by shipping lines, port congestion, customs procedures, or force majeure events.
- Claims: Any claims regarding the condition of the vehicle must be submitted with supporting photographic evidence within 5 days of the vehicle arriving at the destination port. Claims strictly cannot be made on vehicles evaluated with low auction grades (e.g., Grade R, Grade 3 or below) or for minor wear and tear.
7. Termination & Modifications
We reserve the right to suspend or terminate your access to the platform without prior notice if you violate any terms of this Agreement. We reserve the right to modify this Agreement at any time, and your continued use of the platform constitutes acceptance of the new terms.
